Access to the Website and use of the service and content for which the user registers implies acceptance of these General Conditions of Use (hereinafter "GCU").
To accept this GCU, the user must, first of all, have the legal capacity to enter into binding contracts in accordance with the law. By completing the registration form of this Website, the user therefore declares to be of age and to have the capacity to act. If the user does not agree or does not intend to accept the terms and conditions of this GCU, it is sufficient that he does not register or continue browsing the Site, or access the services or contents.
ARTICLE 1. SUBJECT
With these GCU, Puglia-Export sells and remotely purchases the products referred to in the electronic catalog made available on the website.
The offer and sale of Products through the Website constitute a distance contract governed by Articles 45 and ss. of the legislative decree 6 September 2005, n. 206 ("Consumer Code") and subsequent amendments. and by Legislative Decree 9 April 2003, n. 70 and subsequent amendments, containing the discipline of electronic commerce. The contract is concluded exclusively through the e-commerce service on the website, through the user's access to the aforementioned website and the subsequent creation of a purchase order according to the procedure provided by the site itself.
The user undertakes to read these GCU, in particular the pre-contractual information provided by Puglia-Export, before proceeding to confirm his order, and to accept them by ticking the box indicated during registration.
ARTICLE 2 - PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER - art. 49 of Legislative Decree 206/2005
Before concluding the purchase, the user examines the characteristics of the goods / services that are illustrated in the individual description sheets at the time of choice.
Before validating the order with "payment obligation", the user is informed about:

ARTICLE 3 - REGISTRATION TO THE SITE
Registering on the Website is free. To register, the user must fill out the appropriate form, entering name, surname, e-mail address, password and click on the "Register" button.

ARTICLE 4 - USER LIABILITY
The User declares and guarantees that the information provided on the Website for registration and access to services and content is true, complete and up-to-date.

ARTICLE 5 - CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The sales contract is considered concluded with the sending by Puglia-Export to the CUSTOMER of an e-mail confirming the order. The e-mail contains the CUSTOMER data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.
the user undertakes to verify the correctness of the personal data contained in the above email and to promptly notify Puglia-Export of any corrections / changes to be made.
Puglia-Export undertakes to describe and present the goods / services sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the product depicted on the site and the actual product may emerge. The visual representation of the goods on the Site, where available, normally corresponds to the photographic image of the goods themselves and / or their packaging. This representation has the sole purpose of presenting them for sale, without any guarantee or commitment, by Puglia-Export, regarding the exact correspondence of the image depicted on the Site with the real property. In case of difference between the image and the descriptive card, the description of the card always prevails.

ARTICLE 7 - AVAILABILITY OF THE GOODS
The availability of the goods refers to the actual availability at the time the user places the order. However, this availability must be considered purely indicative as:
- the products could be sold to other customers before confirming the order, due to the simultaneous presence on the site of multiple users;
- an IT anomaly could occur such as to make a product available for purchase that in reality is not.
Even after sending the order confirmation e-mail sent by Puglia-Export, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the product or products not available and the user will be immediately informed via e-mail also on the methods and timing of reimbursement of any sums paid.
ARTICLE 8 - PRICES
All the sale prices of the goods / services indicated on the SITE are expressed in Euros, inclusive of any other legal charges and do not include shipping costs.
The user accepts Puglia-Export's right to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated in the order confirmation email sent by Puglia-Export to the user.
In the event of an IT, manual, technical, or any other kind of error that could lead to a substantial change, not foreseen by Puglia-Export, of the retail price, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the user will be refunded within 14 days. from the day of cancellation.
ARTICLE 9 - METHOD OF PAYMENT
Each payment by the user can be made by bank transfer, credit card, debit card, google pay and apple pay.
Payments can also be made with the use of a Gift Card and Loyalty Voucher.
The communications relating to the payment and the data communicated by the user, at the time the transaction is carried out, take place on special protected lines. The security of payment by credit card is guaranteed through two-factor authentication such as VBV (Verified by VISA) and SCM (Security Code Mastercard) certification, however it is guaranteed by the payment gateway used by Puglia-Export.
Once the order has been confirmed, Puglia-Export will generate and send the user an automatic e-mail confirming receipt and will proceed with the order fulfillment.
For payments by bank transfer, the order ID must be entered in the reason for payment. If the bank transfer is not received within 4 days from the time of the order, the latter will be canceled.
ARTICLE 10 - METHOD OF DELIVERY
Puglia-Export will accept orders to be delivered throughout the national territory and in some foreign countries duly indicated in the details of the products marketed. The products will be delivered to the address indicated by the user when placing the order.
Puglia-Export is not required to ship the products until it has received full payment of the price.
In the event that the recipient refuses to deliver the order, the user will be charged the shipping costs and all additional costs for the return to Puglia-Export.
For each order placed on the website, Puglia-Export issues a purchase receipt or invoice for the goods purchased. The sales documents will contain all the data provided by the user during the purchase procedure. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.
Orders are processed by Puglia-Export, every day from Monday to Friday, from 8:30 to 18:00. In the event of an order placed on the weekend and / or on public holidays, the same will be processed on the first working day.
The deliveries of the products will be made according to the methods better specified in the detail sheet of each product
ATTENTION: During the period of sales, promotions, events, holidays or any other possible impossibility due to force majeure, shipments may be delayed or require longer times completely independent of the will of Puglia-Export.
ARTICLE 11 - PASSING OF RISK
The risks relating to the goods will be borne by the buyer from the time of delivery. The ownership of the goods is considered acquired as soon as full payment of all amounts due in relation to them, including shipping costs, is received, or at the time of delivery, if this occurs at a later time.
ARTICLE 12 - LEGAL CONFORMITY GUARANTEE
All goods marketed by Puglia-Export are covered by a 24-month warranty for lack of conformity, pursuant to Legislative Decree n. 24/02. To use the warranty, the user must keep the sales document that he will receive together with the purchased goods.
The 24-month guarantee pursuant to Legislative Decree n. 24/02 applies to products that present a lack of conformity, provided that the same has been used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee, in compliance with Legislative Decree N. 24/92, is reserved only for the private consumer.
In the event of a lack of conformity, Puglia-Export will, at no cost to the user, restore the conformity of the product or reduce the price, until the contract is terminated, but in the event of a minor defect, for which the remedies for repair or replacement are excessively burdensome, it does not give the right to terminate the contract and cancel the order.
The essential characteristics of the Product are indicated in the respective description sheet. The images and colors of the Products on the Site may not correspond to the real ones due to the technical characteristics of the Internet browser or monitor.
The application of any guarantee is excluded in case of use of the Product that does not conform to those of the Product itself and / or to the instructions / warnings on the matter provided by Puglia-Export, or reported in the reference illustrative documentation, on the tags or labels. .
Pursuant to and for the purposes of Directive 1999/44 / EC, of Legislative Decree n. 206/2005 (Consumer Code) and, where applicable, of Directive (EU) 2019/771, the user enjoys the conventional guarantee for a period of 2 years from the date of delivery ("Warranty Period").
For other buyers, who purchase with a VAT number, the legal guarantees referred to in articles 1487 and 1490 and following of the Italian Civil Code will apply. (one year under legal conditions).
The user can exercise this right of withdrawal / return in the manner provided for in Article 13 of the CGU.

ARTICLE 13 - DURATION, WITHDRAWAL AND RETURN
The provisions of these GCU relating to the use of the Website apply from the date of registration on the Website.

The exercise of the right is subject to the following conditions:

The return costs are to be understood as the responsibility of the user.
Puglia-Export will refund, if possible, using the same payment method chosen by the user during the purchase.
In case of withdrawal for the purchase made with a gift card and loyalty voucher, the amount will be returned to the user with a purchase voucher that will be valid for 90 days and can be used by the user for subsequent purchases in an only solution.
ARTICLE 14 - Cases of exclusion of the right of withdrawal
The user cannot exercise the right of withdrawal provided for by art. 13 of the GCU in the following cases: (a) if the order is placed by a non-consumer customer and / or who requires an invoice; (b) if the goods are made to measure and / or clearly personalized; (c) if the goods are likely to deteriorate or expire rapidly (eg oil and wine which undergo alterations if exposed to light and heat for a long time); (d) if the sealed goods, opened after delivery, do not lend themselves to being returned for reasons of hygiene or health protection; (e) sealed food products once opened; (f) if the goods, after delivery, are, by their nature, inseparably mixed with other goods; (g) activated audiovisual products or computer software; (h) newspapers, periodicals, magazines, handouts (i) if the course has already started or videos / textual materials are available.

Puglia-Export may terminate these GCU with immediate effect, by simple written communication via e-mail, if the user has violated one or more of the following provisions of the GCU.
The user acknowledges and accepts that in case of violation of the Law and / or these GCU, Puglia-Export may at its complete discretion suspend or interrupt the provision of the Service, close the account, prevent access to the Website or undertake any other action useful to protect the rights and interests.
ARTICLE 16 - LIMITATIONS OF LIABILITY
Puglia-Export assumes no responsibility if, due to unforeseeable circumstances or force majeure, it fails to execute the order on schedule or if any further disservice occurs.
Puglia-Export cannot be held liable to the user, except in the case of willful misconduct or gross negligence, for disservices or malfunctions connected to the use of the internet and outside the control and management power of the Company itself.
Puglia-Export will also not be responsible for damages, losses and costs incurred by the Customer as a result of the non-execution of the contract for reasons not attributable to the Company, as the user is only entitled to a refund of the price paid.
Puglia-Export assumes no responsibility for any fraudulent or illegal use that may be made by third parties, credit cards, and other means of payment, upon payment of the purchased products, if it proves to have adopted all the possible precautions based on the best science and experience of the moment.
